Marijuana is still illegal in Texas. Possession of up to 2 ounces of marijuana in Texas is considered as a class B misdemeanor. Till 1973, the possession of any amount of cannabis in Texas could lead to minimum two years of imprisonment. The government of Texas later changed the possession of cannabis to a misdemeanor rather than a felony. The Texas Compassionate Use Law that was passed in the year 2015, allowed patients to use cannabis oil that contains less than 0.5 % of THC for the treatment of epilepsy.

The legalization of marijuana for medical uses was a great step on lifting the CBD restrictions in Texas. But the laws regarding the full use of hemp extract is unclear and the recreational use of cannabis in Texas is still illegal. There is a huge loophole in the new bill. According to the bill, cannabis that contains less than 0.3 % of THC is hemp and anything with more than 0.3 % of THC is marijuana, which is illegal.  Currently the law enforcement in Texas has no way to test the contents in the cannabis plant. Therefore, it is one person’s word against the other.

The Governor of Texas, Greg Abbott, signed a bill into law in 2019. This law allows the cultivation of hemp plant in Texas. The law also legalized the sale of CBD oil with less than 0.3 % THC without a prescription. According to the law, the Texas Department of Health and Human Services will have the complete authority in regulating consumable CBD products.
